VybeLocal Policies
Last updated: August 27, 2025
Welcome to VybeLocal. This page covers (1) Refunds & Cancellations, (2) Terms of Use, and (3) Support & Contact. It’s written to be clear and human, with legally required details where needed. If anything here conflicts with applicable law, the law wins.
1) Refunds & Cancellations
Plain‑English TL;DR
- Each event shows a refund policy chosen by the Host (e.g., “Refunds up to 24 hours before start”).
- If a Host or VybeLocal cancels the event, you get a full refund of your ticket and platform fee.
- If you cancel, your refund depends on the event’s posted policy. Platform fees are generally non‑refundable unless the Host/VybeLocal cancels or the law requires otherwise.
- No‑shows are not refundable.
- Refunds usually land in 3–10 business days after approval (your bank controls timing).
- We use a payment processor; some processing fees may be non‑refundable.
1.1 Key Definitions
- Host: The person or organization that creates and runs an event.
- Attendee: A person who RSVPs or purchases a ticket for an event.
- Monetized Host: A Host approved to collect paid RSVPs/payouts through VybeLocal’s payment rails.
- Platform Fee: A small fee added at checkout to keep VybeLocal running (shown at purchase).
- Processing Fees: Fees charged by the payment processor; portions of these may be non‑refundable.
1.2 Host‑Selected Refund Policies
Hosts must pick and display one of these on the event page before RSVPs open:
- Flexible: Full refund until event start time.
- Standard (24‑hour cutoff): Full refund until 24 hours before the event’s start time; no refunds after.
- Final Sale (No refunds): No refunds unless the Host cancels or law requires otherwise.
Important: If an event is canceled by the Host or VybeLocal, Attendees receive a full refund of the ticket price and the VybeLocal platform fee. Where the processor does not return certain fees, the canceling Host may be responsible for those costs under the processor’s terms.
1.3 Changes, Reschedules, and Force Majeure
- Host‑initiated change/reschedule: We’ll notify Attendees via the app/email. You may accept the new date or request a refund up to the earlier of (a) 72 hours after the change notice, or (b) the original event start time.
- Severe weather / force majeure: If an event cannot proceed, Hosts should reschedule or cancel. Refunds follow the rules above; where local laws set special rights, those apply.
1.4 No‑Shows & Late Arrival
If you don’t attend or arrive too late for entry, that is a no‑show and not refundable unless the posted policy says otherwise.
1.5 How to Request a Refund
- Open the event in VybeLocal → Your Ticket/RSVP → Request Refund (if available per policy).
- If you can’t access the app, email support@vybelocal.com with your Order ID, event name, and reason.
Approved refunds are released promptly by the payment processor; banks typically post them in 3–10 business days. Refunds are initiated by the Host (merchant of record) and paid from the Host’s merchant account per processor rules.
1.6 Chargebacks, Fraud & Safety
We may dispute chargebacks and share evidence with the processor. If we see unusual activity (e.g., fraud, abusive refund cycles), we can pause tickets, hold funds, or disable accounts to protect the community. Safety‑related cancellations initiated by VybeLocal result in full attendee refunds.
1.7 Platform & Processing Fees
- Platform fee: Non‑refundable except when the Host/VybeLocal cancels the event or a law says otherwise.
- Processing fees: Portions may be non‑refundable under processor rules. When a Host cancels, Attendees still receive a full refund of what they paid; the canceling Host may be charged these processor costs.
2) Terms of Use
2.1 Who we are
VybeLocal is a platform that helps people create, discover, and attend local events. Hosts run their events; VybeLocal does not control or supervise events unless we’re listed as the Host ourselves.
2.2 Acceptance of Terms
By using VybeLocal (web or app), you agree to these Terms and any policies referenced here (including Refunds & Cancellations and our Privacy Policy). If you don’t agree, please don’t use the service.
2.3 Eligibility
- Attendees: You must be 18+ to use VybeLocal. Some events may set higher age limits.
- Monetized Hosts: You must be 18+ and pass required identity/business verification (KYB/KYC). Events involving alcohol must comply with all applicable laws (including 21+ ID checks where required).
- You’re responsible for complying with local laws and venue policies.
2.4 Accounts & Security
Keep your login secure and your profile information accurate. You’re responsible for all activity under your account. Tell us right away if you spot unauthorized use.
2.5 Fees, Payments & Payouts
- Attendee payments: Collected by our payment processor on the Host’s behalf. We do not store full card numbers.
- Platform fees: Paid by Attendees at checkout and disclosed before purchase.
- Payout timing: For Monetized Hosts (after KYB approval), payouts follow the payment processor’s settlement schedule and are typically sent within ~2 business days of settlement (subject to review, risk holds, or compliance checks).
- Merchant of Record & refunds: Each approved Monetized Host is the merchant of record for their event. Refunds are initiated by the Host and are generally debited from the Host’s merchant balance/settled funds. If insufficient, they may be netted against future payouts or otherwise handled per the processor’s rules. VybeLocal does not fund Host‑initiated refunds except where we are the listed Host or required by law. Note: Our funds‑flow and refund allocation may change based on our payment processor or banking configuration. We’ll update this page before any such change takes effect.
- Holds/Reserves: We may delay or hold payouts (or require a reserve) to manage risk, fraud, chargebacks, or legal/compliance duties.
- No advances: VybeLocal does not extend credit or advance funds; payouts occur only after processor settlement and are subject to any applicable holds/reserves.
- Taxes: Hosts are solely responsible for determining, collecting, and remitting any taxes (e.g., ticket taxes or sales/use tax). Where required, VybeLocal may collect/remit on a Host’s behalf.
- 1099/KYB: Monetized Hosts must provide accurate tax and business information. We (or our processor) may issue forms as required by law.
- Prohibited payment methods: We do not accept prepaid or gift cards.
2.6 Host Responsibilities
- Post accurate event details, pricing, capacity, age limits, accessibility notes, and refund policy before sales open.
- Honor posted refund policies and applicable laws.
- Operate safely and non‑discriminatorily; follow venue rules and applicable alcohol, occupancy, and public‑safety laws.
- Manage check‑ins (including QR codes if used) and maintain credible attendance records.
- Avoid excessive cancellations. Repeated or last‑minute Host cancellations can lead to restrictions or suspension.
- Not misuse the platform for scams, money movement unrelated to real events, or other prohibited activity.
2.7 Attendee Responsibilities
- Read the event page carefully (policy, location, start time, age rules, accessibility).
- Bring any required ID/waivers.
- Be kind; follow venue/Host rules and our community guidelines.
- Don’t attempt ticket scalping or resale unless the Host explicitly allows transfers.
2.8 Content & IP
- Your content: You keep ownership of content you upload but grant VybeLocal a limited license to host, display, and promote your event within the platform.
- Others’ content: Don’t infringe copyrights or trademarks. If you believe something on VybeLocal infringes your rights, contact support@vybelocal.com with details (subject line: IP Concern).
2.9 Prohibited Use
Don’t: break laws; harass others; spam; attempt to scrape or reverse engineer; upload malware; impersonate; or use VybeLocal to facilitate dangerous/illegal activity. We may remove content or disable accounts to protect users and comply with law.
2.10 Assumption of Risk & Release
Attending events involves risk. By participating, you accept those risks and agree that VybeLocal is not liable for incidents arising from an event run by a third‑party Host (to the fullest extent permitted by law). This does not limit rights you may have under non‑waivable consumer protection laws.
2.11 Third‑Party Services
Payments and identity checks may be provided by third parties. Their terms may apply in addition to ours.
2.12 Termination
You can close your account at any time. We may suspend or terminate access for policy violations, risk, or legal reasons. Some terms survive termination (e.g., refunds owed, IP, limitations of liability).
2.13 Changes to These Terms
We may update these Terms. We’ll post the new version with an updated “Last updated” date. Material changes may be communicated in‑app or by email.
2.14 Governing Law & Venue
These Terms are governed by the laws of Texas, without regard to conflict‑of‑law rules. You agree to exclusive venue in state or federal courts located in El Paso County, Texas for disputes that are not subject to other mandatory frameworks.
2.15 Legal Notices
